A 23-year-old man, Dominic David, was on Thursday dragged before an Akure Magistrate Court for allegedly inserting his finger inside the private part of his neighbour’s 5-year-old daughter (name withheld).
The incident happened at 2:pm on January 24, 2023 at Basic Road, Odode Street, Idanre, Ondo State.
It was gathered that the suspect allegedly lured the little girl into his apartment with biscuits and that after defiling her, he asked her not to disclose the act to her parents.
Consequently, the victim’s mother discovered after her daughter told her of pains she was having in her private part.
The victim told her mother that David lured her into his one-room apartment and told her to remove her pants and inserted his finger inside her vagina.
The matter was reported to the police in the area, and David was arrested. He was later transferred to the State Criminal Investigation Department for interrogation over his conduct.
The Police charged the matter to court on the single count of indecent sexual assault.
Police prosecutor, Matins Olowofeso, told the court that the defendant indecently assaulted the innocent girl by applying hair cream on her vagina with his finger.
The prosecutor disclosed that the defendant had previously been arrested for same matter sometimes last year.
Olowofeso said, “Last year, David did same thing to the victim’s elder sister who was ten years old then. And when he was arrested, he signed an undertaking not to do such again upon his release.”
Olowofeso said the victim’s father, one Mr. Oluwafemi promptly reported the case to the police when he caught the defendant again, assaulting the younger sister.
The offence, according to the charge contravenes Section 4 (1) and (2) of the VAPPLAW of Ondo State 2021.
The prosecutor canvassed that the court has the right to keep him away from the society because of his babaric manner .
He, therefore, prayed for an adjournment to enable him file an application for the remand of the defendant.
The plea of the defendant was not taken.
The Defence Counsel, O. Olawale, urged the court to grant the defendant bail, saying he is still presumed to be innocent.
The Magistrate, Folashade Aduroja, ordered the remand of the accused at the police custody
Aduroja adjourned the case til February 9, for mention.
